CMI GOLD & SILVER WEBSITE TERMS AND CONDITIONS OF SALE

1. AGREEMENT TO TERMS
BY USING THE CMISILVER.COM WEBSITE AND/OR PLACING AN ORDER WITH CMI GOLD & SILVER INC. (“CMI,” “we,” “us,” OR “our”), YOU (“Buyer,” “customer,” OR “you”) ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS OF SALE (“Terms”). IF YOU DO NOT AGREE, DO NOT USE THIS WEBSITE OR PLACE AN ORDER.
These Terms constitute the entire agreement between you and CMI Gold & Silver Inc. regarding the purchase and sale of precious metals and related products and supersede all prior representations, understandings, or agreements relating thereto.
2. ELIGIBILITY
You must be at least 18 years of age and legally capable of entering into binding contracts under applicable law to purchase from CMI. By placing an order, you represent and warrant that you meet these requirements. CMI reserves the right to refuse service, cancel orders, or terminate accounts at its sole discretion.
3. PRICING & MARKET CONDITIONS
3.1 Spot Price Fluctuation
Precious metals prices are determined by global market forces and fluctuate continuously throughout the trading day. All prices quoted on this website are indicative only and are subject to change at any time without notice. The final transaction price is confirmed at the time your order is accepted and payment is received.
3.2 Order Confirmation & Price Lock
No price shall be considered locked or binding until CMI has issued a written order confirmation to you via email. If market conditions shift materially between the time of your inquiry and the time of payment, CMI reserves the right to revise pricing prior to confirmation. CMI is not responsible for losses arising from price movements between inquiry and confirmed order.
3.3 Pricing Errors
In the event a product is listed at an incorrect price due to a typographical error, system error, or other cause, CMI reserves the right to cancel any order placed at the incorrect price, whether or not the order has been confirmed or payment processed. In such cases, you will be notified promptly and any funds received will be fully refunded.
4. PAYMENT TERMS
CMI accepts the following forms of payment:
– Personal check, cashier’s check, or money order (payable to CMI Gold & Silver Inc.)
– Bank wire transfer
– Credit and debit cards at trade shows/in-person only until e-commerce is available (a processing fee may apply; see current fee schedule at time of purchase)
Personal checks are subject to a holding period of up to 10 business days to allow for clearance before orders are shipped. Orders paid by wire transfer are generally processed within 1-2 business days of confirmed receipt. CMI reserves the right to hold shipment until payment has fully cleared.
Returned checks or failed electronic payments will result in immediate cancellation of the associated order. The customer shall be responsible for any fees associated with returned or dishonored payments, including but not limited to any fees incurred by CMI.
5. ORDER PROCESSING & AVAILABILITY
All orders are subject to product availability at the time of confirmed payment. In the event an ordered product is unavailable, CMI will contact you to offer a comparable substitute or a full refund. CMI makes no guarantee as to the availability of any specific product, mint, vintage, or denomination. Market demand, minting schedules, and supply chain conditions may affect product availability without advance notice.
CMI reserves the right to limit order quantities at its sole discretion.
6. ALL SALES FINAL — NO RETURNS OR EXCHANGES
ALL SALES OF PRECIOUS METALS, BULLION COINS, BARS, AND RELATED PRODUCTS ARE FINAL. CMI GOLD & SILVER INC. DOES NOT ACCEPT RETURNS, EXCHANGES, OR CANCELLATIONS ONCE AN ORDER HAS BEEN CONFIRMED AND PAYMENT PROCESSED.
Due to the volatile and time-sensitive nature of precious metals pricing, the value of gold, silver, platinum, and palladium products may change significantly from the moment of purchase to the moment of any proposed return. Accordingly, no exceptions to this policy will be made regardless of the reason for the return request, including but not limited to:
– Change of mind or buyer’s remorse
– Market price movement after purchase
– Delay in delivery within published shipping timeframes
– Discovery of publicly available product information after purchase
EXCEPTION — Shipping Damage or Verified Error: The sole exception to our no-return policy applies to products that are (a) demonstrably damaged during transit, or (b) materially and verifiably different from the product ordered (e.g., wrong item shipped). Claims under this exception must be reported to CMI within 48 hours of delivery with photographic documentation. CMI’s determination as to whether a valid claim exists is final. Approved claims will result in replacement of the product or, at CMI’s sole discretion, a full refund.
7. SHIPPING & INSURANCE
CMI ships all precious metals orders fully insured via registered mail or a reputable third-party carrier. Orders are shipped in nondescript, unmarked packaging to protect the privacy and security of the recipient. Specific carrier and service level will be selected by CMI based on order value and destination.
Title and risk of loss transfer to Buyer upon delivery of the package to the carrier. CMI’s insurance coverage remains in effect until confirmed delivery. In the event of a lost or damaged shipment, Buyer must notify CMI within 48 hours of the expected delivery date to initiate a claim.
CMI offers free insured shipping on qualifying orders. Current shipping thresholds and fee schedules are posted at cmisilver.com and are subject to change without notice.
Delivery timeframes provided by CMI are estimates only and are not guaranteed. CMI is not responsible for delays caused by carrier issues, weather, customs, or other circumstances beyond our control.
8. BUY-BACK & LIQUIDATION POLICY
IMPORTANT: Due to continuously changing market conditions, the rate at which CMI purchases metal from customers CANNOT and WILL NOT be locked in at the time of any inquiry or general discussion. Any general pricing estimates or ranges provided by CMI brokers are informational only and do not constitute a commitment, offer, or guarantee of any specific purchase price.
When you wish to sell precious metals to CMI, the following terms apply:
– Purchase prices are based on current spot market pricing at the time the metals are received, evaluated, and a formal offer is made by CMI.
– Any general numbers, estimates, or ranges discussed in advance — whether by phone, email, or otherwise — are provided solely as a general reference and are subject to change based on market conditions at the time of actual liquidation.
– CMI’s formal buy-back offer will be presented upon receipt and inspection of the physical metal. You are under no obligation to accept the offer.
– If you decline CMI’s offer, your metals will be returned to you at your expense.
– Once a buy-back offer is accepted and confirmed in writing, that price shall be the final agreed-upon purchase price.
CMI is under no obligation to purchase any metals presented for sale. The decision to make an offer is at CMI’s sole discretion, taking into account product type, condition, authenticity, and current market conditions.

9. RISK DISCLOSURE
INVESTING IN PRECIOUS METALS INVOLVES SIGNIFICANT RISK, INCLUDING THE POSSIBLE LOSS OF PRINCIPAL. The value of gold, silver, platinum, and palladium fluctuates and may decrease as well as increase. Past performance is not indicative of future results. Nothing on this website or communicated by CMI personnel constitutes investment advice, financial advice, or a recommendation to buy or sell any commodity, security, or investment product.
CMI strongly encourages all customers to consult with a licensed financial advisor before making investment decisions. CMI’s brokers do not earn commissions and will not pressure you to purchase any product, but they are also not licensed financial advisors and cannot provide personalized investment advice.

CMI’s total liability to you for any claim arising out of or related to a specific transaction shall not exceed the dollar amount paid by you in connection with that specific transaction.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, CMI’s liability shall be limited to the greatest extent permitted by applicable law.

13. REGULATORY COMPLIANCE
CMI Gold & Silver Inc. complies with all applicable federal and state regulations governing the purchase and sale of precious metals, including anti-money laundering (AML) regulations and IRS reporting requirements. Certain transactions may require the completion of IRS Form 1099-B or Form 8300. By transacting with CMI, you agree to provide all information required by law and to cooperate fully with CMI’s compliance obligations.
CMI reserves the right to decline any transaction it believes may violate applicable law or its internal compliance policies.

All content on the cmisilver.com website, including but not limited to text, graphics, logos, images, and software, is the property of CMI Gold & Silver Inc. or its content suppliers and is protected by applicable U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without prior written permission from CMI.
15. GOVERNING LAW & DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or any transaction with CMI shall be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
In the event of any dispute, both parties agree to attempt to resolve the matter informally before initiating formal legal proceedings. Formal disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, unless either party elects to bring a claim in small claims court for matters within the applicable jurisdictional limits.
YOU AND CMI WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR ANY TRANSACTION WITH CMI.

16. MODIFICATIONS TO THESE TERMS
CMI reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the website or placement of an order following the posting of any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

SMS POLICY
These SMS / Text Messaging Terms and Conditions (“SMS Terms”) govern your consent to receive text messages (“Messages”) from CMI Gold & Silver / CMIGS (“CMI,” “we,” “us,” or “our”) sent through our AI chatbot and email marketing platforms, including any third-party messaging or automation providers we use to deliver Messages (collectively, the “SMS Program”). By opting in to the SMS Program, you agree to these SMS Terms. These SMS Terms supplement, and should be read together with, our website Terms and Conditions and Privacy Policy.
1. DESCRIPTION OF THE SMS POLICY
The SMS Program may send the following types of Messages to the mobile number you provide:
• Marketing & Promotional Messages — pricing alerts, specials, promotions, and other marketing communications.
• Transactional / Order Messages — order confirmations, shipping and delivery updates, payment notices, and account-related alerts.
• Customer Service / Chatbot Messages — two-way conversational messages in response to your inquiries through our AI-powered chatbot, which may use automated technology to generate replies.
Message frequency varies based on your interactions with us and the types of Messages you opt in to receive. You may receive recurring messages.
2. CONSENT TO RECEIVE MESSAGES
By providing your mobile phone number and opting in through our website, chatbot, checkout process, email sign-up form, or other enrollment method, you expressly consent to receive Messages from CMI at the mobile number provided, including Messages sent using automated technology.
Consent to receive marketing Messages is not a condition of any purchase. You may make purchases from CMI without enrolling in the SMS Program.
You represent that you are the account holder or authorized user of the mobile number provided, and that you are at least 18 years of age.
3. MESSAGE AND DATA RATES
Message and data rates may apply based on your mobile carrier plan. CMI is not responsible for any fees charged by your wireless carrier for sending or receiving Messages. Delivery of Messages is subject to effective transmission from your wireless carrier and is not guaranteed. CMI is not liable for delayed or undelivered Messages.
4. HOW TO OPT OUT
You may opt out of receiving Messages at any time by:
• Replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any Message you receive from us; or
• Contacting us directly using the information in Section 8 below; or
• Any other reasonable method of communicating your request to revoke consent.
After you reply STOP (or another recognized opt-out keyword), we will send a one-time confirmation message and you will no longer receive Messages from that program, unless you re-enroll. Opting out of marketing Messages does not opt you out of necessary transactional communications required to service an order you have already placed (such as a shipping notice for goods you purchased).
If you use multiple mobile devices or numbers to interact with the SMS Program, you must submit an opt-out request for each number separately.

6. AUTOMATED GENERATED AI MESSAGES
Some Messages, including replies from our AI chatbot, are generated using automated and/or artificial intelligence technology. While we aim for accuracy, automated responses may occasionally be incomplete or contain errors. Messages from our chatbot are provided for general customer service purposes only and do not constitute financial, investment, tax, or legal advice. For binding order details, pricing, or account information, please confirm directly with a CMI representative or your official order confirmation.
7. SUPPORTED CARRIERS
The SMS Program is available on most major U.S. wireless carriers. Carriers are not liable for delayed or undelivered Messages. T-Mobile is not liable for delayed or undelivered messages.
8. PRIVACY
Your mobile phone number and information you share with our chatbot will be used in accordance with our Privacy Policy, available at cmi-gold-silver.com. We do not sell or share mobile opt-in data with third parties for their own marketing purposes. Text messaging originator opt-in data and consent will not be shared with any third parties for marketing purposes.
9. CHANGE TO THE SMS TERMS
We may update these SMS Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued participation in the SMS Program after changes are posted constitutes acceptance of the updated SMS Terms.
10. DISCLAIMER OF WARRANTIES
Limitation of Liability
The SMS Program is provided on an “as is” and “as available” basis. CMI makes no warranties, express or implied, regarding the SMS Program, including as to timeliness, accuracy, or reliability of Message delivery. To the fullest extent permitted by law, CMI is not liable for any damages arising from your use of, or inability to use, the SMS Program, including but not limited to delayed, undelivered, or misdirected Messages.
11. GOVERNING LAW
These SMS Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, and are subject to applicable U.S. federal law, including the Telephone Consumer Protection Act (TCPA) and CTIA Messaging Principles and Best Practices.
